The Equality Act 2010 makes it unlawful for a
school to discriminate against a pupil or
prospective pupil by treating them less
favourably because of their skin colour,
nationality or ethnic or national origin.
WHAT DOES It is unlawful to discriminate because of the skin
colour, nationality or ethnic or national origin
THE LAW of a person with whom the pupil is associated.
SAY? It is unlawful to discriminate on the grounds of
a perceived protected characteristic.
A teacher who treats a pupil less favourably
because of their perceptions of the pupil's skin
colour, nationality or ethnic or national origin
will be discriminating on grounds of race
whether or not their perceptions are correct.
