Case Study
Antonio is a Portuguese national living in the UK, and he is
applying for a technical role within a university. Within the job
advert, there is a requirement that says the applicant needs to be
a “native English speaker”. Antonio continues to apply for the
role because he is bilingual and meets the other requirements
stated within the job advert. However, he is rejected for the job
because is he a non-native English speaker.
Is this a case for discrimination?
Yes, this is a case of indirect racial discrimination. Although
Antonio speaks English, he was not hired due to his background.
What should this organisation do?
This organisation needs to review their hiring policy. This indirect
discrimination has excluded various individuals from different
racial, ethnical, and national groups.
Staff should take diversity training to ensure this does not
happen again.
